These Terms and Conditions (the “Terms”) govern your rights and obligations regarding your access and use of the websites (including www.kabby.io), applications (including the Kabby App), and software, and any content, documentation, functionality, products, and services offered thereon (collectively, the “Kabby”) provided by Kabby Technologies Inc. or our subsidiaries or affiliates (“Kabby”, “we”, “us”, or “our”). These Terms constitute a fully binding agreement between Kabby and you, the user of the website and/or the application specified in an order (herein referred to as “you” and “your”), so please read them carefully.
By using the Site and/or the Application, you accept and agree to be bound by and comply with these terms and our privacy policy, found at Kabby Privacy Policy, incorporated herein by reference. if you do not agree to these Terms or the Privacy Policy, you must immediately cease access and use of the Site and the Application.
By using the Site and/or the Application, you represent and warrant that you are the legal age of majority under applicable law to form a binding contract with Kabby. If you are under the legal age of majority, you must not access or use the Site.
You will need to register an account to use the Kabby application. You're responsible for accurate registration details and their confidentiality.
Use Kabby for personal, non-commercial purposes in line with all laws. Misuse, like fraudulent bookings, is prohibited.

Kabby may update these Terms periodically. Continued use signifies acceptance of updates.
These Terms are under Canada/Newfoundland and Labrador law. Disputes will be resolved in its courts.
Fares are calculated by distance, time, or both. Prices can change based on demand, availability, offers, or local municipality regulations. Payments are processed in the Application via our payment process partner/vendor.
Some cancellations may have fees. Check the Application's cancellation policies during booking.
Passengers must respect the driver, vehicle, and other passengers. Misbehavior may result in termination of the ride or future use of the App.

Kabby may terminate or suspend a driver's account for any violation of these Terms.
Kabby does not provide transportation services, and Kabby is not a transportation carrier. Kabby is not a common carrier or public carrier. It is up to the Driver to decide whether or not to offer a ride to a Rider contacted through the Kabby application, and it is up to the Rider to decide whether or not to accept a ride from any Driver contacted through the Kabby application. We cannot ensure that a Driver or Rider will complete an arranged transportation service. We have no control over the quality or safety of the transportation that occurs as a result of the services. Any safety-related feature, process, policy, standard, or other effort undertaken by Kabby is not an indication of any employment or agency relationship with any Driver or Passenger.
Kabby connects passengers with independent drivers. Kabby isn't liable for driver actions or omissions. Drivers are not employees of Kabby. Claims from a ride should go to the respective driver or their insurance.
